Court dissolves three-year-old marriage on wife’s request
An Area Court sitting at Centre-Igboro, Ilorin, Kwara State on Tuesday dissolved the Islamic marriage between Omolara Bekaiye and Nurudeen Olaniyan on wife’s request.
The Presiding Judge, Toyin Aluko, granted the divorce after the husband, of Temidire Street in Sango Area, Ilorin, accepted his wife’s application for divorce and custody.
Aluko ruled that the mother should have custody of the two children from the marriage and the father should have unrestricted access to the children.
Delivering judgement on maintenance fees, the court said that, according to Islamic law, the father should cater for the children.
He said, “Considering the financial capacity of the father, as well as the prevailing economic reality, we have to strike a balance between the two amount of money prayed by the parties. The father should pay N10,000 monthly for maintenance of the two children, starting from November 30, through the registry of this court, for record purpose.’’
The court, however, said that aggrieved party has the right of appeal to the Upper Area Court, within 30 days from judgement day.
Earlier, the wife told the court that she was no longer interested in the marriage, due to lack of love, affection and care.
She applied for divorce, custody and maintenance fees of N20,000 for the two children in the marriage.
The husband agreed to the divorce and custody, but said that he could only pay N5,000 for maintenance, saying, “I am out of job and I have an aged mother to cater for.”
