The National Industrial Court in Abuja has declared the removal of the Chief Judge of Benue State, Justice Maurice Ikpambese, as unconstitutional, null, and void.
In a judgment delivered on Wednesday in Suit No. NICN/ABJ/68/2025, Justice Osatohanmwen Obaseki-Osaghae ruled that the actions taken by the Benue State House of Assembly and Governor Hyacinth Alia violated both constitutional provisions and legislative procedures.
The court held that the removal contravened Section 292(1)(ii) of the 1999 Constitution and specific provisions of the Benue State House of Assembly Standing Orders, 2023.
It also nullified a February 18, 2025, press statement issued by 13 lawmakers announcing Justice Ikpambese’s dismissal.
“A perpetual injunction is hereby granted, restraining the 3rd to 6th defendants from initiating or carrying out any action aimed at removing or suspending the claimant from office without following due constitutional process,” the court ordered.
Additionally, the court barred the National Judicial Council (NJC) from considering any petition from the Benue State Governor or Attorney General regarding disciplinary action against the Chief Judge.
Justice Obaseki-Osaghae dismissed all preliminary objections raised by the defendants, affirming the competence of the suit and granting all reliefs sought by Justice Ikpambese.
Citing various constitutional provisions, the judge ruled that any attempt to remove a Chief Judge without the involvement of the NJC amounts to a violation of due process.
The court also emphasized that the failure to provide Justice Ikpambese with a fair hearing further invalidated the entire removal procedure.
