Court adjourns hearing on Osun LG tenure dispute

The Federal High Court sitting in Osogbo, Osun State, on Monday adjourned till November 27, 2025, the hearing of a suit filed by chairmen and councillors elected during the October 15, 2022, local government elections.

The suit, filed by Onibonokuta Saheed and seven others on behalf of the elected officials, seeks judicial clarification on the exact duration of their tenure and the legality of a subsequent election conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025.

The claimants, all members of the All Progressives Congress (APC), are contending that their tenure remains valid and are asking the court to determine whether OSSIEC had the authority to organise another poll while their term was still running.

Joined as defendants in the suit, numbered FHC/OS/CS/147/2025, are the Attorney General of the Federation, the Inspector-General of Police, the Attorney General of Osun State, the Osun State Government, the Osun State House of Assembly, and OSSIEC.

At Monday’s proceedings, counsel for the claimants, Muhydeen Adeoye, moved a motion seeking an order to restrain the defendants from removing the elected officials from office pending the determination of the substantive case.

However, defence counsel — F. Labo-Popoola, Rachael Ojomi, and J. A. Ayanyemi — argued that they were still within the legal timeframe to respond to the originating summons.

Presiding judge, Justice Adefunmilola Demi-Ajayi, directed that all court processes be properly served on the defendants and assured the parties that the court would give the case accelerated hearing.

The matter was subsequently adjourned to November 27, 2025, for hearing.
