Malami gets interim bail as court fixes date for hearing

The Federal High Court sitting in the Federal Capital Territory (FCT), Abuja, has granted interim bail to a former Attorney-General of the Federation and Minister of Justice, Abubakar Malami, in an ongoing case instituted by the Economic and Financial Crimes Commission (EFCC).

Justice Bello Kawu granted the application on Tuesday, December 23, 2025, while ruling on Motion No. M/17220/2025 before the Abuja Judicial Division.

The court ordered that the interim bail be granted on the same conditions earlier imposed by the EFCC.

These include the surrender of Malami’s international passport and the execution of bail bonds by two sureties.
The sureties, according to the order, are the Director-General of the Nigerian Legal Aid Council and a serving member of the House of Representatives representing the Augie/Argungu Federal Constituency.

Justice Kawu further reviewed and reactivated the bail conditions earlier fulfilled by the applicant on November 28, 2025, which also required the provision of the two sureties and the surrender of the international passport.

The court held that the interim bail was granted on the grounds of exceptional hardship, pending the hearing and determination of the substantive motion on notice.

The matter was adjourned to January 5, 2026, for the hearing of the motion on notice.
