Court strikes out divorce case over couple’s absence

A Grade 1 Area Court in Abuja, on Wednesday, struck out a divorce case between one Aishat Adamu and her husband, Kasim Abubakar.

Adamu, who resides at Gosa, Airport Road in the Federal Capital Territory, had prayed the court to dissolve her marriage, due to her husband’s refusal to provide for the family.

However, when the case came up for hearing on Wednesday, none of the parties were in court.

The presiding judge, Alhaji Aliyu Kagarko, noted that parties had not been present in court for a number of sittings.

He added that since the two parties were not in the court for the hearing of their case, the case would be struck out.

Earlier, the petitioner, in her petition told the court that the respondent had pronounced a divorce on her on October 25, 2024.

She therefore sought the court’s assistance to take custody of her children.

She also prayed the court to compel the respondent, to provide for the maintenance of their children’s upkeep, in terms of feeding, school fees and medical fees.

The petitioner also told the court that the marriage was blessed with four children, Amrat Kasim, 20, Rahmat Kasim, 18, Yusuf Kasim, 16 and Hawa Kasim, 11 years old respectively.

She had also told the court that Abubakar, had at a time, told her to borrow him some money, to the tune of N250,000, for the children’s upkeep, which she did, adding that he never refunded it.
