Court bars EFCC from arresting Anambra bishop over land sale dispute

The Anambra State High Court in Awka has restrained the Economic and Financial Crimes Commission (EFCC) from arresting the Bishop of Awka Diocese (Anglican Communion), Alexander Ibezim, over an alleged unauthorised sale of church land.

Justice F.I. Aniukwu issued the interim order after considering a motion ex parte dated September 4, filed by Ibezim through his counsel, B.E.I. Nwofor (SAN).

The application, brought under the Fundamental Rights (Enforcement Procedure) Rules, sought to protect the cleric from arrest or detention pending the determination of the substantive suit.

In the ruling, the court held that the EFCC, its agents or representatives must refrain from taking any action against the bishop until all parties exchange processes and the motion on notice is heard.

The judge added that the interim order would remain in force for 21 days unless renewed.

The order followed a petition dated July 28, submitted to the EFCC’s Enugu Zonal Directorate by Chief G. Tagbo (SAN) on behalf of Echezona Onuigbo of St. Faith Cathedral, Awka.

The petition accused Bishop Ibezim of illegally selling church land, stressing that only the Board of Trustees has the authority to dispose of church property.

The substantive case is expected to come up for hearing in the coming weeks.
