Reps moves to investigate INEC over delay in by-elections

The House of Representatives has resolved to investigate the Independent National Electoral Commission (INEC) over its delay in conducting by-elections to fill vacant legislative seats.

This decision followed a motion presented by Rep. Jafaru Leko (APC-Bauchi) during plenary on Tuesday.

Leko highlighted that since the conclusion of the 2023 general elections, several legislative seats had become vacant due to resignations, deaths, and appointments of former lawmakers into executive positions.

He referenced Section 68 of the 1999 Constitution (as amended), which outlines the conditions under which legislative seats are declared vacant.

Additionally, he cited Section 76(2), which mandates INEC to conduct by-elections within one month of a vacancy being declared.

He expressed concern that the prolonged delay in holding these elections was disenfranchising affected constituents, violating the constitutional principles of representation.

According to him, failure to conduct timely by-elections denies citizens their right to adequate representation, disrupts legislative activities, and undermines democratic governance.

Leko warned that if electoral laws are not strictly adhered to, it could set a dangerous precedent where compliance with constitutional provisions becomes optional rather than mandatory.

Following the debate, the House directed its Committee on Electoral Matters to summon INEC leadership for an explanation regarding the delay and the steps being taken to resolve the issue.

Additionally, Speaker Tajudeen Abbas instructed the Committee on Legislative Compliance to monitor the implementation of the resolution and report back within four weeks for further legislative action.
